1. Introduction

Kalindra Italia is committed to transparent, fair return procedures that comply with applicable legislation.

This Return Policy governs the return of products purchased through https://kalindra.it, withdrawal periods, return shipping costs, transportation responsibilities and refunds.

Mandatory consumer rights under Italian Legislative Decree No. 206/2005 (Consumer Code) and applicable European legislation remain fully effective.

Different conditions may apply to purchases made by businesses and professionals acting in the course of their activities.

2. Right of withdrawal

Subject to statutory exceptions, consumers purchasing goods online have 14 days to withdraw from the contract without providing a reason.

For goods, the withdrawal period generally begins when the consumer, or a designated third party other than the carrier, takes physical possession of the products, in accordance with applicable law.

To exercise this right, the consumer must send an unequivocal withdrawal statement within the applicable period.

The notification should identify the customer and relevant order.

3. Return deadline

Following withdrawal, the consumer must return the products without undue delay and within 14 days of communicating the withdrawal, unless Kalindra Italia has offered to collect them.

The deadline is met if the goods are dispatched before the period expires.

Customers are encouraged to request the appropriate return address and shipping instructions.

Requesting instructions is not a mandatory condition for exercising the right of withdrawal.

4. Return costs borne entirely by the customer

For voluntary returns arising from a change of mind, personal preference or the exercise of the statutory right of withdrawal, all direct return shipping costs are borne entirely by the customer, provided this obligation was properly disclosed before the contract was concluded.

These costs may include:

• Return transportation charges.
• Carrier surcharges.
• Packaging materials and services.
• Special handling and transportation services.
• Optional shipping insurance.
• Additional services requested from the carrier.

Kalindra Italia does not offer free returns for a change of mind and does not reimburse independently arranged return shipping costs, unless otherwise expressly agreed or required by law.

For goods that cannot normally be returned by post, the required pre-contract information on return costs is provided.

5. Arranging return transportation

Customers who independently arrange a return select and contract directly with their carrier.

They are responsible for choosing a service suitable for the product's weight, dimensions, fragility and value.

Claims relating to the performance of the chosen carrier may be pursued against that carrier under the transportation contract and applicable law.

Mandatory consumer rights against Kalindra Italia remain unaffected.

6. Packaging responsibility

Customers arranging their own return transportation are responsible for preparing packaging appropriate to the goods.

Reasonable precautions must be taken against impacts, crushing, vibration and foreseeable transportation risks.

Use of suitable original packaging, where available, together with appropriate protective materials is recommended.

Original packaging is not mandatory for exercising the right of withdrawal.

Damage directly attributable to inadequate customer-prepared packaging is assessed under applicable law.

7. Shipping insurance

Kalindra Italia strongly recommends insuring return shipments for an amount appropriate to the value of the goods, especially for fragile, expensive, heavy or bulky products.

The customer chooses and pays for any insurance.

Without insurance, compensation available from the carrier may be limited.

Insurance is not mandatory for exercising the statutory right of withdrawal.

8. Tracking and documentation

Customers arranging their own returns are encouraged to use a tracked service and retain:

• Proof of dispatch.
• Tracking number.
• Transportation documentation.
• Insurance documents, if applicable.
• Photographs of the goods and packaging before dispatch.

These documents may assist in resolving transportation disputes.

Tracked shipping is recommended but is not an additional legal requirement for withdrawal.

9. Condition of returned products

Consumers may inspect products to the extent necessary to establish their nature, characteristics and functioning.

Consumers may be liable for any diminished value resulting from handling beyond what is necessary for that inspection, as provided by Article 57 of the Italian Consumer Code.

Opening the packaging or not retaining the original packaging does not automatically remove the right of withdrawal.

Statutory exceptions remain applicable.

10. Products excluded from withdrawal

The right of withdrawal does not apply in the cases expressly provided for by Article 59 of the Italian Consumer Code.

Depending on the legal requirements, exclusions may include:

• Custom-made or clearly personalised goods.
• Goods liable to deteriorate or expire rapidly.
• Sealed goods unsuitable for return for health protection or hygiene reasons once unsealed after delivery.
• Other product categories expressly excluded by law.

Exclusions apply only where their statutory conditions are satisfied and the required pre-contract information has been supplied.

11. Defective or non-conforming products

Customer-paid voluntary return rules do not apply to returns necessary to obtain statutory remedies for defective or non-conforming goods.

Where a lack of conformity exists, consumers are entitled to the applicable statutory remedies without bearing costs that the law places on the seller.

Customers are encouraged to contact customer service before independently shipping defective products so that appropriate arrangements can be made.

Failure to request instructions does not extinguish statutory rights.

12. Incorrect or incomplete orders

If an incorrect product is delivered or an order is incomplete, customers should notify customer service.

Kalindra Italia will investigate and apply the relevant contractual and statutory remedies.

Costs necessary to correct a seller's breach are allocated according to applicable law.

13. Loss or damage during return transportation

Where customers arrange transportation independently, liability for loss or damage is assessed according to the circumstances, carrier contract and applicable law.

Customers should ensure appropriate packaging and proper handover to the carrier.

Kalindra Italia is not liable for damage directly caused by inadequate packaging prepared by the customer, to the extent permitted by law.

Refund rights and the conditions for withholding reimbursement remain governed by Article 56 of the Italian Consumer Code, including the legal relevance of evidence of dispatch.

Choosing a carrier independently or declining insurance does not automatically extinguish the right to reimbursement.

14. Refunds

Where withdrawal is validly exercised, Kalindra Italia reimburses amounts due without undue delay and no later than 14 days after receiving the withdrawal notification.

Unless it has offered to collect the goods, Kalindra Italia may withhold reimbursement until it receives the goods or evidence that they have been dispatched, whichever occurs first.

Refunds include the original standard delivery charges to the extent required by law.

Additional charges for a delivery service more expensive than the least expensive standard option offered are not refundable.

Direct return transportation costs incurred by the customer remain the customer's responsibility and are not reimbursed, unless otherwise agreed or required by law.

Refunds are made through the original payment method unless otherwise expressly agreed, without reimbursement fees for the consumer.

15. Voluntary exchanges

Requests to exchange products because of size, colour, model or personal preference, where they are neither statutory withdrawal nor conformity claims, are subject to the applicable commercial conditions.

Any associated transportation or handling charges will be communicated and agreed.

Statutory withdrawal and warranty rights remain unaffected.

16. International returns

For voluntary returns from abroad, customers bear the direct return transportation costs, in accordance with the information provided before purchase.

Customers are responsible for arranging transportation and completing sender-side shipping and customs documentation.

Any duties, taxes or clearance charges are governed by applicable law and previously disclosed terms.

Customers are encouraged to request instructions to avoid address or documentation errors.

17. Business purchases

The statutory consumer right of withdrawal does not automatically apply to purchases made by businesses or professionals acting in the course of their activities.

Voluntary business returns are subject to expressly agreed conditions.

Applicable statutory and contractual rights remain effective.

19. Updates and final provisions

Kalindra Italia may update this Return Policy to reflect legal or operational changes.

Updated versions are published on the Website with the revision date.

Changes do not retroactively affect existing contracts except where permitted by law.

This policy supplements the General Terms and Conditions of Sale and the Shipping and Payment Information.

Mandatory statutory provisions prevail over conflicting terms.

Important notice regarding return costs

Voluntary returns are not free of charge. Customers bear all direct return transportation costs, packaging expenses and any optional insurance costs. Customers independently arranging transportation are responsible for selecting the carrier and preparing suitable packaging, within applicable legal limits.

This rule does not apply to costs of statutory remedies for defective or non-conforming goods where the law requires the seller to bear those costs.
