KALINDRA ITALIA — WWW.KALINDRA.IT
Version dated 23 October 2026
The website www.kalindra.it (hereinafter the “Website”) is commercially operated by:
Kalindra Italia di Fornasier Matteo & C. S.a.s.
The company, hereinafter referred to as “Kalindra Italia” or the “Seller”, markets goods and services to consumers, businesses and professionals through electronic sales channels.
The Website uses the Ecwid e-commerce platform. Ecwid acts as a technology service provider and does not, solely by virtue of providing the platform, become the seller of products marketed by Kalindra Italia.
Unless expressly stated otherwise before purchase, the sales contract is concluded directly between the Customer and Kalindra Italia.
These General Terms and Conditions govern the offering, purchase, payment, delivery and after-sales management of products and services sold through the Website.
They apply to purchases by private consumers and business customers, subject to the distinctions established by applicable law.
These Terms are drafted with reference, among others, to the applicable provisions of:
Mandatory legal provisions shall prevail over any conflicting contractual clause.
Seller: Kalindra Italia di Fornasier Matteo & C. S.a.s.
Customer: any person or entity browsing the Website or placing an order.
Consumer: a natural person acting for purposes outside their trade, business, craft or profession.
Business Customer (B2B): a person or entity purchasing in the course of business or professional activities.
Product: any tangible goods, goods with digital elements or digital content offered for sale.
Service: any service contractually offered through the Website.
Order: the purchase proposal submitted through the electronic ordering process.
Order Confirmation: the communication expressing the Seller's acceptance of an order under Article 6.
Purchases may be made by adults who have the legal capacity to enter into binding contracts.
Customers undertake to provide accurate, complete and up-to-date information, including identification details, billing and delivery addresses, contact details, tax information and any information required for delivery.
The Seller may request clarification where inconsistencies or irregularities arise.
Kalindra Italia undertakes to provide clear and reliable information about the essential characteristics of its products.
Product listings may include images, descriptions, technical specifications, dimensions, materials, compatibility, availability and instructions for use.
Images are illustrative but do not justify substantial differences from the contractually agreed characteristics.
Significant changes to ordered products require the Customer's consent.
Products subject to specific regulations must be used in accordance with applicable warnings and instructions.
The Seller will correct catalogue errors of which it becomes aware.
Customers select products and add them to the electronic shopping cart.
Before submitting an order, Customers may review quantities, prices, additional charges, delivery details and other required information.
The final ordering button shall clearly indicate the obligation to pay.
Submitting an order constitutes an offer to purchase.
An automated acknowledgement of receipt does not necessarily constitute acceptance.
The contract is formed when Kalindra Italia expressly accepts the order or otherwise communicates unequivocal acceptance.
Advance payment alone does not constitute acceptance.
If an order is not accepted, any amounts collected will be refunded in full without undue delay.
The Seller provides Consumers with contractual confirmation and mandatory information on a durable medium in accordance with applicable law.
Prices are displayed in the currency indicated on the Website.
Consumer prices include applicable taxes, subject to clearly disclosed tax-specific arrangements.
For professional offers, prices excluding VAT must be clearly identified.
The total price and calculable additional charges are disclosed before purchase.
Where certain charges cannot reasonably be calculated in advance, Customers are informed that additional costs may arise.
Prices may change without affecting contracts already concluded.
Discounts and promotions comply with applicable price transparency requirements.
Kalindra Italia takes reasonable measures to minimise errors in published prices, availability and product specifications.
If an error is discovered before order acceptance, the Customer will be informed and may place a new order under the corrected conditions.
If an error is discovered after contract formation, the Seller may propose a mutually agreed solution.
Remedies under the Italian Civil Code remain applicable where their legal requirements are met.
An error does not automatically entitle the Seller to cancel a validly concluded contract unilaterally.
Product availability may depend on the Seller's warehouses, suppliers and inventory management systems.
Kalindra Italia endeavours to keep commercial information up to date.
If a product becomes unavailable after an order is placed, the Customer will be promptly informed.
Depending on the circumstances, the Seller may propose restocking, an alternative product subject to consent, cancellation by mutual agreement, or termination where legally permitted with reimbursement of amounts due.
Products will not be replaced with different items without Customer consent.
Supplier unavailability does not automatically release the Seller from contractual obligations.
Accepted payment methods are those actually displayed during checkout.
Transactions may be processed by external payment service providers.
Kalindra Italia does not request passwords, security codes or other confidential payment credentials by ordinary email.
Order processing may be suspended where payment is refused, incomplete or unauthorised.
Refunds are processed in accordance with applicable law.
Kalindra Italia issues tax documentation in accordance with applicable law.
Customers requiring an invoice should provide the necessary details promptly, preferably before completing their order.
Business Customers may be required to provide their company name, VAT number, address and other relevant tax information.
Kalindra Italia's electronic invoicing recipient code is T04ZHR3.
Tax documents are issued and transmitted in accordance with current regulations.
Kalindra Italia ships to destinations worldwide, subject to the availability of logistics services and compliance with applicable laws.
The ability to ship a particular product may depend on the destination, physical characteristics, weight, dimensions, carrier availability, trade restrictions, customs regulations, import or export prohibitions, and safety or certification requirements.
Worldwide shipping coverage does not guarantee that every product can be delivered to every location.
Available destinations and delivery charges are disclosed before contract formation.
For shipments to countries or territories subject to customs formalities, customs duties, import taxes, local levies and customs clearance charges shall be borne by the recipient Customer, unless expressly stated otherwise in the offer.
Before purchase, Customers are informed of potential additional charges and, where these cannot reasonably be calculated in advance, of the possibility that such charges may become payable.
Amounts may vary according to customs classification, goods value, destination and local legislation.
Customers must reasonably cooperate with import procedures.
Refusal to pay charges lawfully payable by the Customer will be handled in accordance with applicable law.
Storage, return or reshipping costs may only be charged where lawful, documented and consistent with the contractual information provided.
Special tax or customs regimes may apply to certain territories, including territories associated with EU Member States.
Processing and delivery times may vary according to product type, stock availability, procurement lead times, supplier, transport method, destination and customs procedures.
Applicable delivery periods are communicated before purchase.
Unless otherwise agreed, goods sold to Consumers must be delivered without undue delay and no later than 30 days after contract formation, in accordance with Article 61 of the Italian Consumer Code where applicable.
In the event of late delivery, Consumers may exercise statutory remedies, including allowing an appropriate additional period where required and subsequently terminating the contract.
In circumstances provided by law, termination may occur without an additional period.
Amounts due following lawful termination will be refunded in accordance with statutory requirements.
Kalindra Italia may use external warehouses, suppliers and logistics providers to prepare and dispatch orders.
Goods may be shipped directly from these facilities to the Customer.
This arrangement does not change the identity of the Seller.
Kalindra Italia remains responsible for its contractual obligations towards Consumers.
For Consumer contracts, the risk of loss or damage transfers when the Consumer, or a designated third party other than the carrier, takes physical possession of the goods.
Where the Consumer independently appoints a carrier not offered by the Seller, the specific provisions of Article 63 of the Italian Consumer Code apply.
For Business Customers, the transfer of risk is governed by valid contractual arrangements and, failing those, the Italian Civil Code.
Customers are encouraged to inspect packaging and goods upon delivery.
Visible damage should preferably be documented and promptly reported to customercare@kalindra.it.
Accepting a parcel without reservation does not automatically extinguish statutory Consumer rights.
Claims are assessed under applicable conformity warranty and Seller liability rules.
Customers must provide complete and accurate delivery information.
Where delivery fails because of incorrect details, lack of cooperation or recipient unavailability, Kalindra Italia will contact the Customer to seek a solution.
Additional costs directly attributable to the Customer may only be requested where legally permitted and previously disclosed.
Mandatory Consumer protections remain unaffected.
Unless a statutory exception applies, Consumers may withdraw from a distance contract within 14 days without giving reasons.
For sales of goods, the period generally begins when the Consumer, or a designated third party other than the carrier, receives physical possession.
For separate deliveries, the period may begin upon receipt of the final item, as required by law.
For services, the period generally begins when the contract is concluded.
Withdrawal may be exercised by sending an unequivocal statement to:
or by written communication to Kalindra Italia's registered office.
The optional form in Annex A may be used.
No explanation is required.
Any additional legally required withdrawal mechanisms made available through the Website remain applicable.
Following withdrawal, Consumers must return the goods without undue delay and within 14 days of communicating their decision, unless the Seller has offered to collect them.
The official return address is:
Kalindra Italia di Fornasier Matteo & C. S.a.s.
Via San Giorgio, 6
33098 San Martino al Tagliamento (PN)
Italy
Email: customercare@kalindra.it
Direct return costs are borne by the Consumer if properly disclosed in advance, unless otherwise agreed.
For goods that cannot normally be returned by post, legally required information concerning return costs will be provided.
Original packaging is recommended but its absence does not automatically invalidate withdrawal.
Consumers are liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, where provided by law.
Following valid withdrawal, Kalindra Italia refunds all amounts due, including standard initial delivery charges within statutory limits.
Refunds are made without undue delay and within 14 days of receiving the withdrawal notification.
Unless the Seller has offered collection, reimbursement may be withheld until the goods are received or proof of return dispatch is provided, whichever occurs first.
Refunds use the original payment method unless expressly agreed otherwise and without cost to the Consumer.
No penalties apply to lawful withdrawal.
Withdrawal does not apply in the circumstances specified by Article 59 of the Italian Consumer Code.
Subject to statutory requirements, these may include:
Exceptions are assessed individually and do not automatically apply to entire product categories.
Applicable exclusions are disclosed before contract formation.
Goods sold to Consumers are covered by the statutory guarantee of conformity under the Italian Consumer Code.
For new goods, the Seller is liable for lack of conformity existing at delivery and becoming apparent within two years, subject to applicable law.
For second-hand goods, a shorter liability period may be agreed where permitted, but not less than one year.
Depending on the legal requirements, Consumers may be entitled to:
The availability and sequence of remedies are governed by the Consumer Code.
Repair and replacement must be free of charge, completed within a reasonable period and without significant inconvenience.
The legal guarantee is provided by the Seller and does not depend on supplier or manufacturer availability.
Commercial warranties offered by manufacturers or Kalindra Italia are additional to, and do not replace, statutory rights.
Their duration, scope, geographical coverage and conditions are specified in the relevant documentation.
Extended warranties are optional.
Declining an extended warranty does not reduce statutory guarantee rights.
Purchases made for business or professional purposes are governed by the Italian Civil Code and any applicable special rules.
The statutory Consumer withdrawal right does not automatically extend to B2B transactions.
Any commercial return rights granted to Business Customers must be expressly agreed.
Warranties against defects and applicable time limits follow the relevant law, including Article 1495 of the Italian Civil Code where applicable.
Customer classification depends on the actual purpose of the purchase and not solely on possession of a VAT number.

Mandatory information concerning manufacturers, responsible economic operators, warnings and traceability is provided as required by law.

Certain products may require installation, assembly, maintenance or operation by qualified personnel.
Applicable technical and legal requirements must be observed.
Unless expressly included, installation, assembly, testing and maintenance services are not included in the product price.
The Seller's responsibility for non-conformity arising from inadequate instructions or contractually included installation remains unaffected.
Where digital content or services are offered, specific conditions are disclosed before purchase.
Relevant Consumer Code provisions apply, including those concerning conformity and updates where required.
Performance during the withdrawal period is subject to statutory consent and information requirements.
Loss of withdrawal rights cannot be inferred from payment alone.
Kalindra Italia is responsible for performing its obligations under applicable law.
Using suppliers, carriers, external warehouses or technology providers does not automatically exclude the Seller's contractual liability.
Nothing in these Terms excludes or restricts liability where prohibited by law.
Mandatory provisions concerning intentional misconduct, gross negligence, personal injury, product safety and statutory guarantees remain unaffected.
Force majeure refers to extraordinary events not attributable to the affected party that make performance impossible under the conditions established by law.
The affected party shall promptly inform the other party of relevant circumstances and foreseeable consequences.
Force majeure does not automatically extinguish Customer rights or entitle the Seller to retain amounts not legally due.
Effects on performance or termination are governed by applicable law.
Where the Website allows reviews or other user content, users must comply with applicable laws and third-party rights.
Unlawful, defamatory or misleading content is prohibited.
Where Consumer reviews are published, Kalindra Italia provides the legally required information about any procedures used to verify their origin.
Fabricated reviews or reviews falsely attributed to genuine Customers will not be presented as authentic.

Purposes, legal bases, recipients, retention periods and data subject rights are explained in the Website's Privacy Policy.
Data required to fulfil orders may be shared with parties involved in contractual and logistics operations within legal limits.
Acceptance of these Terms does not automatically constitute consent to optional processing requiring separate authorisation.
Kalindra Italia may send communications necessary for order fulfilment and customer support.
Marketing communications comply with applicable law.
Separate consent is obtained where required.
Customers may exercise data protection rights through the contact channels indicated in the relevant Privacy Policy.
Kalindra Italia encourages amicable resolution of disputes.
Complaints may be sent to customercare@kalindra.it and formal communications to kalindraitalia@pec.it.

Alternative dispute resolution (ADR) mechanisms may be available to Consumers under applicable law.
The former European Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025.
Contracts are governed by Italian law, without prejudice to mandatory Consumer protection provisions that may apply.
Consumers residing in other countries retain mandatory protections available under applicable private international law.
Jurisdiction over Consumer disputes is determined by the relevant mandatory rules.
For disputes between business parties, subject to mandatory rules or another valid agreement, the Court of Pordenone, Italy, is designated as the agreed competent court.
Kalindra Italia may update these Terms for legal, organisational, technological or commercial reasons.
Updates are published on the Website with their effective revision date.
